There are limitations on various policies with respect to how you and the driver are related, if any, which may drastically affect your ability to recover. A look into your policy is the first thing to do in this situation. Likewise, if your driver was at fault, then his/her insurance policy should cover your injuries under his policy. Of course, keep in mind that you are seeking compensation from an insurance company and not directly from a person’s own pockets, per se (insurance rates aside, of course).
